Job Description
Reporting to the Head of Legal, this role provides legal advice to Assets primarily located in Chile, managing regulatory, contractual and operational matters. This role advises the business in complex environmental matters, in the identification and management of legal risks, and gives strategic advice.
Main functions:
- Provide legal and strategic advice to Minerals Americas business on a variety of issues, including, but not limited to mining, environmental, contractual and corporate issues.
- Business support, such as interpretation and application of regulation, contracts’ clauses, clarification of legal implications around commercial and technical decisions, third party claims, among others.
- Negotiate and draft all kind of contracts as required by the BHP’s Minerals Americas business.
- Define the strategy for, and manage, local litigation.
- Give legal advice in relation to administrative investigations against the company, defend the company in such investigations and manage legal actions.
- Advice on all matters relating to financial issues, including advice related to loan facility agreements, bank guarantees and others.
- Manage outside legal counsel engagements to ensure productive and cost-effective representation.
- Actively represent Legal in different forums within the company, attending meetings as appropriate.
- Participate in material risk assessments and verification.
- Execute analysis and improvement activities as required.
- Contribute to the adequate management of the legal budget.
- Own the implementation of the Legal governance requirements.
- Advise the Head of Legal and management representatives on all significant matters.
REQUIREMENTS AND COMPETENCIES
3 – 7 years of experience working as a lawyer. Prior top law firm experience required. Experience drafting and negotiating sophisticated contracts, both in English and Spanish.
Strong background in environmental and regulatory experience.
Business oriented, good commercial aptitude, strong negotiation and communication skills. Team player, always focused on building team spirit and participating in team activities. Self-motivated – strong personal work ethics with a focus on “getting it done”.
Time management skills and ability to manage and deliver multiple projects simultaneously with competing deadlines. Travel within Chile and internationally, as necessary.
Advanced English proficiency.
EDUCATION AND CERTIFICATIONS Law degree from a Chilean university. Valid Chilean practicing certificate.
